DuPont Files Federal Lawsuit to Protect Titanium Technologies Intellectual Property

Monday 11. April 2011 - On April 6, DuPont filed a lawsuit against USA Performance Technology, Inc. (USA PTI), Performance Group (USA) Inc. and two individuals for allegedly misappropriating trade secrets and proprietary information related to the DuPont Titanium Technologies business. The suit was filed in U.S. Federal Court for the Northern District of California.

DuPont is the world’s largest manufacturer of titanium dioxide, a white pigment commonly used in coatings, plastics and paper, as well as a variety of other applications. The suit seeks an injunction requiring the return of all misappropriated confidential or trade secret information and prohibiting the use or release of DuPont’s proprietary information. The suit also seeks unspecified monetary damages, fees and costs.
“As a market-driven science company, DuPont’s action underscores our commitment in protecting proprietary information for the benefit of our shareholders, employees and customers,” said Senior Vice President and General Counsel Tom Sager. “We are taking action to ensure that our trade secrets remain protected. DuPont is working closely with law enforcement authorities with information regarding this matter. We will pursue all appropriate remedies available to address the misappropriation and those responsible.”
