QUADTECH FILES LEGAL ACTION IN U.S. AGAINST Q.I. PRESS CONTROLS
Wednesday 10. June 2009 - Action Follows German Court Infringement Ruling on Register Control
QuadTech, the worldwide leader and innovator of press control technology, has filed a legal action in the United States district court (Eastern District of Pennsylvania) against Q.I. Press Controls for infringing on QuadTechs U.S. patent covering register control technology. The complaint alleges that Q.I. Press Controls register control product (mRC), sold in both mark and markless mode, infringes on U.S. Patent 5,412,577. The founders and owners of Q.I. Press Controls are former QuadTech employees.
This action follows a German court decision that stopped Q.I. Press Controls from infringing on a related patent in Germany. On June 17, 2008, the Düsseldorf district court held in QuadTechs favor that Q.I. Press Controls cannot market or otherwise sell its markless register control system (mRC) in Germany. QuadTech then won an appeal of this decision on December 29, 2008, where the Court of Appeals upheld the injunction against Q.I. Press Controls which subsequently accepted this judgment by the German court.
QuadTechs rights pertaining to its U.S. patent on register control technology date back to 1992. The company holds patents for the same technology in a number of countries, including Germany, the United Kingdom and Japan.
According to QuadTech President Karl Fritchen, “We will continue to be vigilant in protecting our intellectual property. We will evaluate any infringements on a case-by-case basis and act accordingly to protect our rights and the innovative products we bring to the marketplace,” he said. “We are extremely pleased that the German courts ruled twice in our favor against Q.I. Press Controls and look for a similar outcome in the United States.”
